Photography Gallery Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the online photography gallery (the "Gallery"), owned and operated by Media King Marketing Pty Ltd ("we", "us", or "our"). By accessing or using the Gallery, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the Gallery.

2. Use of the Gallery

The Gallery is intended for viewing and sharing photographs taken by Media King Marketing Pty Ltd (the "Photographs"). You may:

  • View the Photographs.

  • Download the Photographs for personal, non-commercial use with the express permission of the client.

  • Share the Photographs on social media platforms, provided you give proper credit to Media King Marketing Pty Ltd (e.g., "Photograph by Media King Marketing Pty Ltd").

3. Prohibited Conduct

You are prohibited from:

  • Downloading or using the Photographs for any commercial purpose without prior written consent from Media King Marketing Pty Ltd and the client.

  • Modifying, altering, or manipulating the Photographs in any way without prior written consent.

  • Using the Photographs in a defamatory, libelous, or offensive manner.

  • Using the Gallery for any illegal or unauthorized purpose.

  • Attempting to gain unauthorized access to the Gallery or any related systems or networks.

  • Interfering with the proper functioning of the Gallery.

  • Violating any applicable laws or regulations.

4. Intellectual Property

All Photographs and content on the Gallery are protected by copyright and other intellectual property laws. Media King Marketing Pty Ltd retains all rights, title, and interest in and to the Photographs.

5. Disclaimer of Warranties

The Gallery is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Gallery will be uninterrupted or error-free.  

6. Limitation of Liability

In no event shall Media King Marketing Pty Ltd be liable for any damages whatsoever, including without limitation, direct, indirect, incidental, consequential, special, punitive, or exemplary damages, arising out of or in any way connected with your use of the Gallery.  

7. Indemnification

You agree to indemnify and hold harmless Media King Marketing Pty Ltd and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including attorneys' fees) arising out of or in any way connected with your use of the Gallery or your violation of these Terms.  

8. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on the Gallery. Your continued use of the Gallery after the effective date of any such changes constitutes your acceptance of the new Terms.  

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa.
